These Terms of Service ("Terms") govern your use of the LinguaBite mobile application (the "App") operated by LinguaBite Ltd ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Use of the App

1.1 Eligibility

You must be at least 13 years old (or 16 in the EU) to use the App. By using the App, you represent that you meet this age requirement.

1.2 Account

You may use the App without an account (offline mode). If you create an account, you are responsible for:

• Providing accurate information.
• Keeping your login credentials secure.
• All activity that occurs under your account.

You must notify us immediately if you suspect unauthorised access to your account.

1.3 Permitted Use

You may use the App for personal, non-commercial language learning purposes. You agree not to:

• Reverse-engineer, decompile, or disassemble the App.
• Copy, redistribute, or republish any content from the App.
• Use the App to develop a competing product or service.
• Use automated tools, bots, or scrapers to extract content or data from the App.
• Attempt to gain unauthorised access to our systems or other users' data.
• Use the App in any way that violates applicable law.

2. Content and Intellectual Property

2.1 Our Content

All content in the App — including sentences, translations, grammatical annotations, audio recordings, IPA transcriptions, exercise designs, and user interface elements — is owned by LinguaBite Ltd or licensed to us. This content is protected by copyright and intellectual property laws.

2.2 Your Content

Any notes, bookmarks, or other content you create within the App remains yours. By using cloud sync, you grant us a limited licence to store and transmit your content solely for the purpose of providing the sync service to you.

2.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without restriction or compensation.

3. Subscriptions and Payments

3.1 Free and Paid Features

The App may offer both free and paid features. Paid features may be offered through subscriptions or one-time purchases via the Apple App Store or Google Play Store.

3.2 Billing

All payments are processed by the respective app store (Apple or Google). We do not directly handle your payment information. Billing terms, refund policies, and cancellation procedures are governed by the app store's terms.

3.3 Price Changes

We reserve the right to change pricing for paid features. Existing subscribers will be notified before any price change takes effect on their next billing cycle.

4. Availability and Modifications

4.1 Availability

We strive to keep the App available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

4.2 Modifications

We may modify, update, or discontinue features of the App at any time. We will make reasonable efforts to notify users of significant changes.

4.3 Content Updates

Learning content (sentences, translations, exercises) may be updated, added, or removed as part of our ongoing content development. Content packs may change between versions.

5. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

• Fitness for a particular purpose.
• Accuracy or completeness of learning content.
• Uninterrupted or error-free operation.
• Compatibility with all devices or operating systems.

LinguaBite is a language learning tool, not a certified educational institution. We do not guarantee specific learning outcomes, language proficiency levels, or examination results.

6. Limitation of Liability

To the maximum extent permitted by applicable law, LinguaBite Ltd shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or goodwill.
• Damages arising from your use of or inability to use the App.
• Damages arising from unauthorised access to your account or data.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or 50 GBP, whichever is greater.

7. Indemnification

You agree to indemnify and hold harmless LinguaBite Ltd, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.

8. Termination

8.1 By You

You may stop using the App at any time. You may delete your account through the App's settings, which will remove your cloud-stored data within 30 days.

8.2 By Us

We may suspend or terminate your access to the App if you:

• Violate these Terms.
• Use the App in a way that could harm us, other users, or third parties.
• Engage in fraudulent or illegal activity.

We will make reasonable efforts to notify you before termination, except where immediate action is necessary.

8.3 Effect of Termination

Upon termination, your right to use the App ceases. Sections 2 (Intellectual Property), 5 (Disclaimers), 6 (Limitation of Liability), 7 (Indemnification), and 10 (Governing Law) survive termination.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Displaying a notice in the App.
• Updating the "Last Updated" date at the top of this document.

Your continued use of the App after changes constitutes acceptance. If you do not agree with updated Terms, you should stop using the App.

10. Governing Law and Disputes

10.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

10.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@linguabite.com. We will attempt to resolve the matter within 30 days.

11. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and LinguaBite Ltd regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: We may assign our rights under these Terms. You may not assign yours without our prior written consent.
